These Terms form an agreement between you and CleanGenius LLC, the operator of CleanGenius in South Carolina, United States.
1. The service
CleanGenius provides software tools intended to help cleaning businesses manage operational information and workflows. Features may include customer records, properties, quotes, schedules, jobs, teams, quality control, documents, communications, invoices, and payment-related records. CleanGenius does not perform cleaning services or guarantee work performed by businesses using the platform.
2. Eligibility and accounts
You must have authority to accept these Terms for yourself or the organization you represent. You are responsible for accurate account information, safeguarding credentials, assigning permissions, and activity conducted through your account.
3. Acceptable use
You may not use the service unlawfully; infringe rights; transmit malicious code; interfere with security or availability; probe systems without authorization; misrepresent identity or consent; send unlawful or unwanted communications; or access another company’s information without permission.
4. Customer data
You retain rights in information submitted to your workspace and authorize CleanGenius LLC to process it to provide and support the service. You are responsible for its accuracy and legality, required privacy notices, communication consent, workforce disclosures, and retention obligations.
5. Third-party services
Optional features may depend on third-party hosting, email, text-messaging, payment, mapping, or document providers. Their availability and separate terms may apply.
6. Fees and payment
Subscription prices, billing frequency, renewals, applicable taxes, refunds, and cancellation terms are presented in the applicable order form or subscription screen. You agree to pay charges you authorize under those terms.
7. Intellectual property
CleanGenius LLC and its licensors retain rights in the platform, software, branding, documentation, and related materials. These Terms grant a limited, nonexclusive, nontransferable right to use the service during authorized access.
8. Confidentiality and security
Each party will protect nonpublic information using reasonable care and use it only for the relationship. Additional data-processing or security terms may apply to business accounts.
9. Availability and changes
The service may evolve and features may be modified. Maintenance, outages, third-party failures, or events beyond reasonable control may affect availability. A service-level commitment applies only when stated in a separate written agreement.
10. Suspension and termination
Access may be suspended for security risk, unlawful use, material breach, or nonpayment. On termination, access ends and data is handled under applicable agreements, retention requirements, and the Privacy Policy.
11. Disclaimers
To the extent permitted by law, the service is provided “as is” and “as available.” CleanGenius does not provide legal, tax, employment, accounting, or professional cleaning advice.
12. Limitation of liability
To the fullest extent permitted by law, CleanGenius LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenues, data, goodwill, or business opportunities arising from use of the service. Nothing excludes rights or liabilities that cannot lawfully be excluded.
13. Governing law
These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles. A dispute not governed by another written agreement will be brought in a court of competent jurisdiction in South Carolina.
14. Changes
Updated Terms may be posted with a revised effective date. Material changes will be communicated where required.
